Terms of Service

1. Agreement

By accessing Pool Buildability Report (“Service”), purchasing a report, creating a waitlist entry, or accessing the Service through an AI agent, automated client, or similar tool acting for a human customer, you agree to these Terms, our [Privacy Policy](privacy.md), [Disclaimer](disclaimer.md), and [Refund Policy](refunds.md). If you do not agree, do not use the Service.

“You” means the human customer and any person or system (including an AI agent) acting on their behalf. The human customer remains responsible for purchases, compliance, and verification duties under the Disclaimer.

2. The Service

We provide informational pool-regulation reports for residential addresses in jurisdictions we explicitly list as covered. Coverage is incomplete nationally; outside covered cities the Service will refuse a full report or offer a waitlist — it will not invent findings.

Any training, fine-tuning, embedding, dataset assembly, long-term index, cache beyond ordinary short-term retrieval, or other ingestion of our site content, reports, corpora, APIs, or structured outputs must:

1. Credit Pool Buildability Report as the source;

2. Point back to the live site with a durable URL (home or the specific page);

3. Not treat free marketing HTML/markdown as a substitute for a paid report; and

4. Ensure that full report findings, jurisdiction packs, and paywalled outputs are obtained only through paid purchases on the same terms as humans (one paid license per address / per report as quoted at checkout) — not by scraping, reconstructing, or bulk-copying our IP.

Public marketing pages and agent mirrors exist to help discovery. They do not license free redistribution of our curated corpora or paid report content.

4.3 Prohibited

You (including any AI agent or operator) may not:

Operators of AI systems are responsible for configuring agents to honor this section. Violation may result in suspension, legal action, and claims for the commercial value of misappropriated IP.

You will not: (a) abuse GIS or geocoding proxies; (b) attempt to bypass paywalls except via authorized admin access; (c) reverse-engineer corpora or the Service to build a competing dataset or product; (d) submit unlawful content; (e) interfere with Service integrity or other users; (f) violate Section 4.

6. Admin and tester access

Authorized admins/testers may run waived ($0) reports for QA and support. That access is personal, revocable, rate-limited, and not a public free tier. It may not be shared with AI agents or end customers.

7. Billing and refunds

Fees are as quoted at checkout for your location tier. Refunds follow the Refund Policy. After a report is generated, purchases are generally non-refundable except as stated there or required by law. Agent-assisted purchases are billed the same as human checkouts.

8. Intellectual property

UI, software, branding, marketing copy, jurisdiction packs/corpora, curated citations, report structure, and generated report content (aside from raw public-government facts in the public domain) are owned by the Service operator or licensed to us. You retain ownership of addresses and other content you submit. You grant us a license to process that content solely to provide the Service.

A paid report license does not transfer ownership of our corpora or software. Third parties (including AI platforms) acquire no broader rights by crawling or assisting a purchase.

9. Disclaimer and liability

The Disclaimer is incorporated by reference. Aggregate liability is capped at fees paid for the applicable report. Agent-assisted use does not expand our liability or create a professional relationship with the agent’s vendor.

10. Changes and termination

We may update these Terms by posting a new version with an updated date. We may suspend access for abuse or non-payment. Provisions that by nature should survive (IP, disclaimer, liability, indemnity, Section 4) survive termination.
